EPA REGULATIONS SPUR CONSTRUCTION & LITIGATION

This blog has been paying careful attention to new EPA rules, and the impact that the Carbon Pollution Standard for New Power Plants (CPSNPP), the Cross-State Air Pollution Rule (CSAPR), and the Mercury and Air Toxics Standards (MATS) will have on construction in the power-generation industry.  The effect thus far has been two-fold:  greater spending on the construction of emissions control systems, and a lawsuit challenging the EPA’s regulations.

Demonstrating the increase in emissions control construction, ADA Environmental Solutions (ADA-ES) reported that revenue from its pollution control technology and services increased 36% for the first quarter of 2012, compared with the same period in 2011.  ADA-ES further estimates that it will realize over four million dollars in revenue for the remainder of 2012 as part of MATS compliance activities.  The EPA has estimated that, industry-wide, MATS compliance will spur $9.6 billion in construction over the next five years.

Taking another approach, a host of energy companies have petitioned the U.S. Court of Appeals for the District of Columbia Circuit to review the EPA’s MATS rule.  The suit, which has consolidated over two-dozen individual petitions under the lead case, White Stallion Energy Center, LLC v. U.S. Environmental Protection Agency, Case No. 12-1100, challenges the EPA’s decision making as contrary to the Clean Air Act, and as arbitrary and capricious.  Briefing remains ongoing; oral argument has not yet been scheduled.
