Kapner recently published an article entitled, “Fired Up and Ready to Go,” in the Fall 2014 issue of The Voice, the official magazine of The Construction Users Roundtable (“CURT”). The article discusses a contractual strategy that would allow a power plant owner to begin generating power prior to Substantial Completion as defined in an engineering, procurement, and construction (“EPC”) contract. The article proposes an innovative approach that can be incorporated into an EPC contract granting an express right to the owner to begin commercial operations prior to the date of Substantial Completion.
