Lawsuit Involving Tenants Association's Assignment of Rights

Represented a developer in two related lawsuits involving a tenants association’s assignment of its rights under the D.C. Tenant Opportunity to Purchase Act (TOPA) to purchase a $40 million high-rise residential apartment building. We sued the tenants’ association for specific performance of a contract to assign to our client the tenants association’s TOPA rights to purchase the apartment building. After successfully obtaining both a temporary restraining order and preliminary injunction barring the tenants association from assigning its TOPA rights to purchase the building to anyone other than our client, and after the owner of the building then brought suit against our client for allegedly impairing the sale of the building to the original contract purchaser, we successfully negotiated a court-approved settlement of the lawsuits that resulted in the assignment of the tenants association’s TOPA rights to another developer in return for a significant payment to our client.
